Tribal Construction Services Safety Policy and Building Codes

SAFETY POLICY

 

UPON ENTERING AN AGREEMENT WITH THE TRIBAL CONSTRUCTION DIVISION OF THE MUSCOGEE NATION, ALL GENERAL CONTRACTORS AND SUB-CONTRACTORS MUST ENFORCE AND COMPLY WITH THE WILLIAMS-STEIGER OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970. STANDARDS OF THIS ACT ARE DOCUMENTED IN THE 29 CFR 1926 OSHA MANUAL CREATED BY U.S. DEPARTMENT OF LABOR, OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION.  IT IS REQUIRED BY THE NATION THAT ALL CONTRACTORS AND SUB-CONTRACTORS ENTERING CONTRACTS WITH THE NATION UNDERSTAND THE TRAINING REQUIRED TO COMPLY WITH THE STANDARDS SET FORTH BY OSHA. THIS WILL BE STATED IN THE CONSTRUCTION DOCUMENTS AND UPON SIGNING WILL BECOME PART OF THE CONTRACT. ANY CITATIONS, FINES, COMPLAINTS OR VIOLATIONS WILL BE THE RESPONSIBILITY AND LEGAL ABATEMENT OF THE GENERAL CONTRACTOR OR SUB-CONTRACTOR.  THE CONTRACTOR WILL ASSIGN A COMPETENT TO HOLD WEEKLY SAFETY MEETINGS DURING THE DURATION OF THE CONSTRUCTION PROJECT. IT WILL BE REQUIRED THAT ALL SITE FOREMEN ATTEND WEEKLY SAFETY MEETINGS AND SIGN OFF ON THE SIGN IN SHEET PROVIDED BY TRIBAL CONSTRUCTION.

IF CONTRACTOR IS NOT REPRESENTED ON A WEEKLY BASIS; THE CONTRACTOR WILL BE SUBJECT TO REMOVAL FROM THE PROJECT AND ABSENCES VIEWED AS A BREACH OF CONTRACT.  ANY CITATIONS, FINES, COMPLAINTS OR VIOLATIONS RECEIVED BY CONTACTOR WILL BE JUSTIFICATION FOR THE NATION TO TERMINATE THE CONTRACT.  THE TRIBAL CONSTRUCTION DEPARTMENT HAS OUTLINED SOME BUT NOT ALL OF THE REGULATIONS SET FORTH BY OSHA INCLUDED IN THIS DOCUMENT. CONTRACTORS SHOULD BE AWARE THIS DOES NOT LIMIT THE SAFETY PRACTICES EXPECTED ON TRIBAL PROJECTS. THE NATION EXPECTS CONTRACTORS TO COMPLY WITH OSHA TO THE MAXIMUM EXTENT OF THE LAW.

BUILDING CODES

 

THE MUSCOGEE (CREEK) NATIONAL COUNCIL ADOPTS THE INTERNATIONAL BUILDING CODE, INTERNATIONAL EXISTING BUILDING CODE, INTERNATIONAL FIRE CODE, INTERNATIONAL MECHANICAL CODE, INTERNATIONAL PLUMBING CODE, INTERNATIONAL ELECTRICAL CODE, AND THE INTERNATIONAL DUEL GAS CODE AS THEREAFTER AMENDED.

APPLICABILITY
THE CONSTRUCTION CODES SHALL APPLY TO ALL CONSTRUCTION OF ANY SIZE, COST, TYPE OR PURPOSE, REGARDLESS OF WHETHER IT IS NEW CONSTRUCTION, ADDITION, OR RENOVATION.

THIS SECTION SHALL NOT APPLY TO THE MERE REPAIR OR MAINTENANCE OF AN EXISTING COMMERCIAL BUILDING OR ACCESSORY STRUCTURE.

THIS SECTION SHALL NOT APPLY TO THE RESIDENTIAL STRUCTURES.

BUILDING INSPECTOR
THE TRIBAL CONSTRUCTION ENGINEER IS APPOINTED AS THE “BUILDING OFFICIAL” AS DESIGNATED IN THE CONSTRUCTION CODES WITH PROJECTS ON TRUST PROPERTIES.

ADOPTED BUILDING CODES
TCS FOLLOWS THE LATEST OKLAHOMA STATE ADOPTED CODES UNLESS OTHERWISE DIRECTED BY THE TRIBAL ENGINEER.  THE LATEST ADOPTED CODES ARE SHOWN AT: http://www.ok.gov/oubcc/Codes_&_Rules/Adopted_Building_Codes/index.html
