Realty Trust Services

Our responsibilities are to understand the processes involved in assisting our Muscogee (Creek) Clients in researching land records. Our office understands the relationship our clients may or may not have with their land. Our office is in clear understanding the information we work with is privileged and protected unless pursuant to 43 Code of Federal Regulations 2.56(b). We understand these records may not be altered or destroyed except as authorized by 43 Code of Federal Regulations 2.52(c).

Services

The objective of the Muscogee (Creek) Nation Realty Trust Services Department is to provide recommendations and related services to individuals in the management of Indian Trust and Restricted Land situated within the Muscogee (Creek) Nation of Oklahoma.

The program consists of Trust-related services mandated by the various Federal Regulations and Laws governing the management of restricted and trust land. There are approximately 128,000 acres of restricted property owned by individual Tribal members in need of assistance managing and protecting their property rights. Our primary goal is to insure that clients do NOT lose their land as a result of any activity that can be prevented by providing proper assistance in the management of their restricted Indian land. An ancillary goal is to maximize the dollar value our clients receive in return for the use and sale of their restricted and trust land. Realty Trust Services also assists the Muscogee (Creek) Nation and its citizens in the transfer of land title to the United States of America in Trust, thus expanding the land base of the Nation and its citizens.

Restricted Property

    • Property is held by the individual in
      restricted status.

 

    • This property is from the original allottee
      who was ½ blood or more.

 

    • Property stays restricted as long as it is
      inherited by a person who is ½ blood or
      more of any combination of the Five-
      Civilized Tribes.

 

    • Property that was allotted or deeded from
      the original allottee (leases, conveyances
      and sales) are handled by the BIA or their
      delegated representative.

 

  • Property that has been inherited through
    probate (sales, leases, conveyances and
    probates) must

Trust Property

    • Property is held by the United States of
      America in Trust for an individual or
      tribe.

 

    • Leases, sales and conveyances are
      handled by the BIA or their delegated
      representative.

 

    • All transactions are approved by the
      Secretary of the Interior.

 

    • Trust property has no blood quantum
      restriction. As long as the person is
      Indian of any tribe they can hold property
      in Trust status.

 

  • A decedent’s Trust property is passed
    pursuant to the Indian Land Consolidation
    Act (ILCA).
